A New York Jury has rejected a claim from a construction worker who sued a New York Presbyterian Hospital for administering an unwanted rectal exam after a workplace injury.
Brian Persaud received eight stitches for a cut over his eyebrow at the hospital after he was hit by a beam. He resisted a request from emergency room personnel for a rectum examination to check for spinal injury, hitting a doctor while flailing around. He claimed that hospital personnel sedated him and performed the examination in retaliation.
Persaud was charged with battery for hitting the doctor, but the charges were dismissed. | |
